Is there anyway to keep my carrier from . . .

 . . . Keep my carrier from recognizing my phone as a Smartphone ? I really do not use the LG820 on AT&T's 3G network to get on the internet , I only use the WiFi for that where available and have proof that I don't over the last 10 months of bills AT&T conveniently tacked on their Data Pro package at $25 extra a month even though I may've at most used 8Mb of Data.

  I bit@#ed at AT&T till I was blue in the face for ripping me off or penalizing me because I needed a Windows based phone for documents , She said I could cancel the Data package but if I put my SIM card back in the phone it will be recognized as a Smartphone and the DATA package will be auto added again , Then said I could cancel if I placed my phone in "Airplane" mode to work on documents , Told her that renders it useless as a "phone" then then .

  So as of now I cancelled the Data Pro plan and have the lowest Data plan but am still tired of them screwing me over just for having a Smartphone and not needing it for Data use ,

  BTW , I or my number is contract free and I own the phone outright , should I look at another carrier or something ?
